Why a house and land package loan Sydney lenders assess is not a normal purchase
A house and land package loan Sydney buyers apply for is different because packages are commonly sold as a land contract with the developer and a separate building contract with the builder. Lenders treat this as a split contract home loan: the land settles first, then funds are released for the build in stages. A simple purchase has one settlement and one contract. A package has two of each, and the timing between them can drift.
Because the pieces are linked, a problem with one can delay the other. Ask your broker to look at both contracts before you pay a deposit, not after.
Two settlements: the land first, then progress payments
House and land finance usually starts with a settlement on the land, funded partly by your deposit and the loan. Once the land is yours, the build begins and the lender releases funds to the builder as stages are completed, often after a valuer or the lender confirms progress. See our guide to progress payments in NSW for how stages are commonly paid.
Expect to pay interest on funds drawn as the build goes on, and plan for any rent or existing housing costs in the meantime. Our guide on how construction loans work explains the mechanics in more detail.
Land registration delays and how they affect your loan
In a new estate, the land is often sold before the title is created. Registration of the new lots depends on the developer, the surveyor and the land registry, and it can take longer than the sales material suggests. Your land settlement usually cannot happen until the title exists, and your build cannot start until you own the land.
That means the dates in your contract and your loan approval need room to move. Ask the seller in writing when registration is expected, and ask your lender how long your approval and valuation remain valid if settlement slips. Approvals can lapse, and a fresh valuation may be needed.
Sunset clauses: the date that can end a contract
A sunset clause sets a date by which the developer must complete the land or the settlement. If the date passes, the contract may give one or both sides a right to end it, subject to the law. In NSW there are rules on when a developer can use a sunset clause, so read the contract with a solicitor and check NSW Fair Trading for consumer guidance.
For your finance, the risk is a change in your circumstances or the market between signing and settling. Ask your broker how a delay might affect your approval, and never assume a deadline is safe because the developer says so.
Deposit, first home buyer support and the numbers to check
Deposits on packages are commonly split between the land contract and the building contract, and the way they are staged affects how much cash you need up front. First home buyer support may apply to a new home or to vacant land, and eligibility depends on your circumstances. Check the current position with Revenue NSW and Housing Australia, and read our first home buyer guide and first home buyer construction loans NSW page.
If you are still deciding between a package and buying land separately, compare it with our pages on vacant land loans and buying land and building. Run the numbers with our Sydney home loan calculators before you commit.
