Knock down rebuild Merrylands: why Cumberland differs from other Sydney councils
Cumberland City Council covers suburbs including Merrylands, Guildford, Granville, Auburn, Lidcombe and Berala, and it applies its own planning document to residential building: the Cumberland Development Control Plan (DCP) 2021, which council says came into effect on 5 November 2021. Part B covers development in residential zones, and the finance question is usually the same: will the lender accept the approved plans and cost?
Council's DCP page also says it was seeking feedback on proposed amendments to the Cumberland LEP and DCP until 5pm on 17 August 2026. Rules can change, so ask council which controls apply when you lodge.
Cumberland Council KDR finance: what the DCP asks of your design
For a dual occupancy, Cumberland DCP 2021 Part B2 says the Low Rise Housing Diversity Design Guide applies and sets minimum site frontages: 15 m for an attached dual occupancy, 18 m for a detached side-by-side dual occupancy, 15 m for a manor house, 18 m for terraces and 20 m for multi dwelling housing. A single new house is guided by Part B1.
This matters to a lender because a design that needs changes late in the process can change the contract price and the valuation. Get the plan approved, or clearly approvable, before the loan is finalised.
Is your Merrylands block in a nominated low and mid-rise housing area?
NSW Stage 1 rules permit dual occupancies in R2 zones from 1 July 2024. Stage 2, from 28 February 2025, applies within 800 metres walking distance of nominated town centres and stations. NSW Planning's site selection page, last updated 21 March 2025, lists these Cumberland locations: Auburn station and town centre, Berala station and town centre, Granville station and Lidcombe station. Merrylands and Guildford were not on that list when we checked. Confirm your own address on the NSW Planning frequently asked questions and the state map.
Council or a certifier: which approval pathway
According to NSW Planning, development applications under the Low and Mid-Rise Housing Policy are generally assessed by the relevant council. The Low-Rise Housing Diversity Code lets well-designed dual occupancies, manor houses and terraces be complying development if they meet the code. Cumberland's DCP page also points applicants to the Low Rise Housing Diversity Design Guide. Ask council which pathway suits your lot.
